 FAQs: Managing within the Law
dotted line

Q. Why do managers need to know the law?
A. Employment law now reaches into every aspect of managers' relationship with their staff. From the time a manager decides to recruit, until an employee leaves the organisation, and sometimes beyond, the law will have an impact. Managers do not need to be lawyers but they do need a practical appreciation of how to manage within the law.

Q. Why do I need to train employees?
A. In terms of harassment, employers are liable for the actions of their employees. Training all employees minimises the risk of them breaking the law and the employer incurring costs and damage to its reputation.

Q. Isn't it the role of HR to know all this?
A. The HR function will have sound legal knowledge and the HR policies and procedures will provide guidance. However, HR problems arise in many ways and educating managers can stop many problems developing. Also, if problems do develop then managers are far more likely to follow the right procedures if they appreciate the law.

Q. Can you do management training by e-learning?
A. Well designed and relevant e-learning that actively involves the manager in the process can enable managers to improve their knowledge and skills.

Q. Why do managers have to participate in two harassment modules?
A. Managers need a sound appreciation of the law on harassment which covers a wide range of situations. However, their role is to build an environment where harassment does not occur and to identify and handle problems if they happen. The first module explains the law, the second focuses on their management responsibilities.

Q. Do participants need to complete a whole module in one session?
A. No, that is the benefit of e-learning. Research shows that trainees will normally spend around 15 to 20 minutes on the training at one time. The system will automatically record where they stop and take them back to the right place when they log-on next time.
